According to the court of appeal, and us as well, the procurer always needs to know and understand the underlying criteria they are referring to and spell them out in the call for tender. Hi Marie, I believe this depends very much on the type of procedure you're involved in. There are no general rules in the Procurement Directives about responding to requests for clarification but this is governed by the principles of equal treatment and transparency.
